FACTS ABOUT MEDIATION
Mediation is FASTER than litigation. A lawsuit can take anywhere from several months to years to be decided. As a rule, Mediation takes about 30-60 days from the time the Agreement to Mediate form is signed by both parties. Also, Mediation is LESS EXPENSIVE than litigation.
Mediation is nonadversarial. Arbitration and litigation focus on disagreements between the parties and result in a win-lose decisions imposed by one person – the Arbitrator or the Judge. Mediation, on the other hand, focuses on an agreement between the parties and results in a win-win settlement reached and agreed upon by the parties themselves.
If parties cannot reach a mutually acceptable settlement during the Mediation Conference, they are free to litigate their dispute as if Mediation never took place.
PROCESS OF MEDIATION
The Association Office offers Clients of REALTORS® who are not Members of our Association and any Member of the Public ($100 Administrative fee) an option to Mediate a dispute over a Buy/Sell of a residential/commercial/vacant land/etc. Once contact has been made to the Association Office (phone, fax, e-mail, etc), paperwork will be sent out to the Complainant(s). He/she will receive the paperwork including: a formal letter directed to the Complainant(s), a DRS Brochure, a list of GLAR approved Mediators, and a Request for Mediation form. Once the documents have been completed and returned from the Complainant(s) and all contact information is obtained for the Respondent(s), the same paperwork is then sent to the Respondent(s). The Respondent(s) has a timeline on when he/she should return the paperwork to the Association Office. The Association has to allow a full 30 days for response. If the Respondent(s) cooperate and returns the documentation, then a Mediator in common is selected; and all information is then sent to that Mediator.
The Mediator contacts the Complainant(s) and the Respondent(s) personally to set up a date/time for the Mediation. If the Respondent(s) doesn’t comply, then a formal letter is sent to the Complainant(s) with our formal apology and at that time both parties are FREE to seek litigation.
